I think Leigh might have meant "how could he have been *allowed* to" if
contracts are so tightly written.


iirc it wasn't quite as straightforward at the time as Anders just deciding
to go work for MS.  Didn't Microsoft and Borland reach a substantial
financial settlement to compensate Borland (my memory is a little hazy, and
I think that settlement was about more than *just* the movement of staff,
although I'm fairly sure that was a significant factor).


Remember that most of these "draconian" conditions in such contracts are not
absolute statements of immutable conditions, they are usually prohibitions
on certain activities or actions being undertaken without prior
permission/consent/authorisation.

Negotiating the terms of consent might involve some form of compensation or
further agreement between the involved parties.
