[Paymex] trust account

I was wondering, the fact that Paymex said that our funds were held in a trust account, and then the fact that they hadn't actually set up a trust account according to the liquidator; is there somehow we can bring a court case against the directors of the company?  Isn't this some sort of misrepresentation?

How can we believe that this new company has actually set up a trust account?
